OF CONDUCT FOR:-

TURF CLUB
PIETERMARITZBURG
TURF CLUB
DEFINITION AND
INTERPRETATION : 1.
1.1 the Board: the
Board of club directors.
1.2 the club:
1.3 the clubs:
1.4 club premises: any
premises owned or occupied by any of the clubs or by Gold Circle or at which
any of the clubs or Gold Circle carry on business at any time, including any
premises which may be utilized by the clubs or Gold Circle for any event or
function.
1.6 members: members
of the clubs.
1.7 officials: employees,
club directors, directors, stewards or any other such representative or office
bearer of the clubs or
1.8 Words not defined
in these rules shall have the same meaning as in the constitution of the club.
INTRODUCTION: 2.
2.1 In order to:
2.1.1 maintain the good name of the club
and horse racing in general;
2.1.2
achieve the objects of the club; and
2.1.3
ensure that members can exercise their rights as members and
have full use and enjoyment of the club’s facilities without infringement by
other members;
it is necessary that members conduct
themselves in a fit and proper manner.
2.2 In terms of the club’s constitution the Board has the
power to make rules for the conduct of the club and of members.
2.3 The
Board has accordingly formulated the following rules to regulate members’
conduct.
GENERAL CONDUCT: 3.
3.1
Members shall recognise and respect not only their own
rights and responsibilities but also conduct themselves with due regard to the
rights, dignity, safety and welfare of other members, officials and members of
the public.
3.2
Members are to conduct themselves in a manner which
maintains the reputation and orderly functioning of the club in terms of its
constitution.
3.3
Where any member has a disagreement with the club he/she
shall submit such matter in writing to the Board and attempt to seek resolution
with the club.
3.4
Members are responsible for the conduct of their guests
PROHIBITED CONDUCT: 4. Members
shall not:-
4.1
abuse, antagonise or threaten, assault or threaten to
assault employees, officials, club members or members of the public when on
club premises,;
4.2
make public statements to the media or otherwise which have
the affect of damaging the good name and reputation of the club or horseracing
in general;
4.3
neglect or willfully refuse to comply with any rule relating
to membership of the club or to areas designated for members on club premises
or any lawful or reasonable request of an official;
4.4
use crude or offensive language on club premises;
4.5
cause any willful damage to property at any club premises;
4.6
discriminate against officials, employees or other members
with regard to, but not limited to, race, sex, religion or age;
4.7
issue false statements or declarations to the Club or
4.8
make any misrepresentations or fail to disclose information
to the Club or
4.9
invite as a guest to club premises a person who would not
otherwise be entitled to utilize members’ facilities;
4.10
conduct themselves in a manner which undermines, adversely
affects or is in conflict with a decision of the disciplinary committee;
4.11
for any corrupt, dishonest or unlawful purpose in connection
with horse racing or breeding, give, offer or promise, either directly or
indirectly any inducement reward or bribe of whatever nature to anybody
whomsoever;
4.12
tamper with or ill treat any horse;
4.13
interfere with, threaten or intimidate an owner, trainer or
rider of any horse or an employee in any racing stable in connection with horse
racing;
4.14
improperly obtain information about a trial, or about any
horse in training from any owner, trainer, rider or anybody else employed in a
racing or training stable or in the services of the owner or trainer of such
horse;
4.15
interfere with, tamper with or intimidate anybody (including
any witness) or anything (where applicable) involved in or concerned with an
enquiry, investigation, objection, appeal or review held or to be held by the
Horse Racing Authority in terms of its constitution or rules;
4.16
abuse, swear at, mislead, intimidate, threaten or interfere
with any person involved in the administration or the control of racing;
4.17
commit, or incite or conspire with anybody to commit any
corrupt, fraudulent, dishonest or prohibited practice in relation to racing or
breeding in any country;
4.18
be a member of any Racing Club in
4.19
without lawful reason be a party to or incite any other
person to perform any act, or by omission create a circumstance which does or
might lead to the abandonment, postponement or interruption of any race or race
meeting;
4.20
place a bet or bets on a horse with an intention of altering
the totalisator pool so as to create a favourite, which in the absence of such
a bet or bets would not be a favourite;
4.21
contravene, in a province concerned, any provisions of the
provincial legislation relating to horse racing and betting;
4.22
be on any premises occupied by an unlicenced bookmaker or
totalisator operator or any party operating as an unlicenced bookmaker or
laying illegal bets;
4.23
do anything or fail to do anything which may have the affect
of preventing a horse from winning a race or obtaining the best possible place
in a race or from running in a race;
4.24
do anything or fail to do anything which may render a horse
a danger or source of danger or interference to other horses or to persons
taking part in race or to other persons present at a racecourse;
4.25
breach any rule of the National Horseracing Authority as may
be applicable to a member;
4.26
conduct themselves in a manner which is contrary to the best
interests of the club or horseracing in general.
CONDUCT IN RESPECT
OF VOTING: 5.
5.1
Members hold voting rights in respect of the clubs. The
clubs, in turn, may only vote as shareholders of
5.2
As such, and without detracting from the rights of members
to freely exercise their votes, members are required to exercise their rights:-
5.2.1
subject to the powers and capacity of the clubs in terms of
the clubs’ Constitutions and applicable legislation;
5.2.2
in the best interests of the clubs and of
5.2.3
through the exercise of independent discretion and without
undue influence from others;
5.2.4
avoiding any conflict of interest with the clubs or
5.2.5
by disclosing any pecuniary interests which may, directly or
indirectly, affect a member’s vote.
NOT EXHAUSTIVE: 6. The
lists in paragraphs 4 and 5 are not exhaustive and shall include any other
conduct which the Board may regard as contrary to the standards required of
members.
EFFECTIVE DATE: 7. These rules of conduct shall
come in to effect and be binding on members with effect from August 2004.
